At 7:18 a.m. on April 23, 2020, an employee was working for a landscaping servic e. He was a regular full-time employee. He had been sent to work on the middle i sland of a public avenue in Riverside, CA. He was getting orange traffic cones a nd trash bags from a coworker, who was in the back of the company truck, a white Ford F350 with license number 6W70575. The employee took the cones to his posit ion on the ground about 120 meters (400 feet) away. The cones were intended to c ontrol traffic. The truck was equipped with flashing lights, which were operatin g. Two signs had been put 210 meters (700 feet) and 105 meters (350 feet) away f rom the worksite on both sides of the road as a warning for traffic in both dire ctions. The two workers had put cones close to the truck before the incident. A privately-owned vehicle, a 1999 Toyota Camry, with license plate number 8CCA368, hit the employee and then the company truck in its rear. The employee was throw n by the striking vehicle. He landed on the road. He had been killed. The cowork er was thrown out of the truck and onto the ground. Their employer had all traff ic control procedures per the watch-book, which was inside the company truck. Th e employee was pronounced dead at the site by the county sheriff department. The coworker sustained contusions on his left ribs, and a swollen and fractured lef t leg. He was taken to a hospital and released in two to three hours. A represen tative of the risk management consultants for the employer reported the injury t o the San Bernardino District office of the Division at 11:15 a.m. on April 23, 2020. The Riverside County Coroner Department also reported the injury to the Di vision, at 7:38 a.m. on April 23, 2020. The employer met the Division's reportin g requirements. A CSHO from the District office arrived at the site at 8:40 a.m. on April 23, 2020 at 0840 hours. No accident-related violation was cited.

On Oct. 3, 2003, a 57-year-old utility worker was killed when a vehicle entered his short-duration work zone and struck him. The worker was in the process of locating underground gas lines for construction work taking place on both sides of an active five lane suburban road. The worker parked his vehicle half on the sidewalk and half on the bike lane to avoid obstruction, and placed two orange safety cones behind the vehicle on the edge of the bike lane to warn motorists of the work zone. The worker was standing near the left rear of his vehicle using a locator device when struck. The 18-year-old motorist in the incident was reportedly using a cell phone when her vehicle drifted off the roadway. The victim was pronounced on scene by the medical examiner.

The utility worker had worked for the utility company for over 29 years and was considered very knowledgeable on setting up a work zone. He was working alone on this occasion. The company follows the Manual on Uniform Traffic Control Devices (MUTCD) for guidance in establishing its work zones. According to company policy, the worker was wearing an orange T-shirt and hard hat. His placement of safety cones to the rear of his vehicle was determined to be appropriate for the work being conducted. Posted speed on the roadway was 35 mph. 041b061a72
